The W-8BEN or W-8BEN-E is a United States (U.S) Department of the Treasury Internal Revenue Service (IRS) requirement that allows you, as a foreign investor, to claim concessional tax treaty benefits (including a reduced rate of withholding tax).

Form W-8BEN is meant for foreign individuals or sole proprietors. Form W-8BEN-E, is meant for non-U.S. entities including companies and organisations.

Upon opening an AUSIEX International Markets Account, your client will receive an email to complete a new digital W-8 form. The email will contain a hyperlink, username and temporary password. Your client will be required to complete the digital W-8 form and submit. This will then be validated by the Custodian.

If your client does not complete or does not have a valid W-8BEN or W-8BEN-E on file, any payments (e.g., dividends and sale proceeds) credited to their account may be subject to a withholding tax of 30% to cover the U.S. Department of the Treasury IRS withholding tax liabilities.

The W-8 form remains in effect until 31 December three (3) calendar years from the year it is signed, or a change of circumstances invalidates any information on the form, such as a change of name or residency. If any of these details change, your client is required to complete a new W-8 form.

If your client does not have the original W-8 email which was provided to them during the account opening stage, you will need to complete the W-8 PDF available here.

If your client has retained the original digital W-8 link, they can login using their existing username and password to recomplete. Once completed, the form can be submitted.

When selecting the hyperlink from the original email, select the ‘Forgot Password’ option. Your client will be prompted to enter their username and email address to reset the password. A temporary password will be sent to their email address.
